Introduction
1.1 Necessary for our service
In order to provide our services and care, it is necessary to collect certain data. The reasoning behind this is because it is necessary for proper handling and to correctly send the invoices. Furthermore, for services that we do not offer personally, we might have to refer your data with the third party. This is only possible with your consent and if it is in the interest of (dental) care.
1.2 Legal obligations
The dental practice is legally obliged to keep patient files for 15 years. If you are no longer a patient with us and the legal retention period has expired, this data will be deleted.
1.3 To whom does this privacy statement apply?
This privacy statement applies to all past, current and prospective patients. It is also applicable to people who visit the website.
1.4 Who is responsible for your data?
Our dental practice is responsible for processing, collecting and using your data.
Personal data and processing thereof
2.1 What is personal data?
The General Data Protection Regulation (GDPR) states that personal data is all information about an identified or identifiable natural person. This means that information is either directly or indirectly traced back to this individual. When registering at our dental practice, we ask for several personal data, namely your name, address, date of birth, bank account number, telephone number and email address.
2.2 What does processing entail?
By processing we mean the collection, storage, use, consultation and provision of data to third parties who perform services for us.
2.3 Why do we need your consent for the processing?
Processing personal data is only allowed if there is a legitimate reason for it. This is often an agreement to a treatment or a legal obligation. Consent is given by individuals of 16 years and older. Under the age of 16, the parent or caretaker gives consent. If consent is not given, we unfortunately can no longer offer our services to you. Excellent care can only be provided if all relevant data is available. Furthermore, there is also a legal obligation to keep a medical file in order to guarantee the quality of the provided care.
What do we do with your data?
3.1 Registration
When registering as a new patient, you will also be asked for your social security number. That is why we need to check your ID card or passport.
3.2 Referral
If you have to be referred to a specialist for a certain treatment, your personal data will be forwarded. Accepting the appointment is seen as permission to share your data.
3.3 Payment
Upon processing the invoice, your name and address details will be shared with the health insurer or factoring company. We keep our invoices for the debtors administration.
3.4 Health insurance
If you have dental insurance, your relevant personal data will be exchanged with the health insurance. Your health insurance can also request data for a check-up, in which case we are legally obliged to provide the requested data.
3.5 Visiting the website
When visiting our website, data is processed through cookies.
3.6 Reporting incidents
If your personal data is used incorrectly or we suspect that this is happening, a report will be sent to the Dutch Data Protection Authority. If this has any consequences for you, we will inform you as soon as possible.
3.7 Processor
We may need to share your data with third parties, such as an administrative office or an IT supplier. If this is the case and the third party qualifies as a processor, we will enter into a processing agreement with this party, in order to ensure the protection of your privacy.
Duties of the dentist
4.1 Security
Healthcare providers are bound by professional confidentiality and are not allowed to share private information between the healthcare provider and patient to others. Information in your personal file is only shared with those involved in a treatment or with explicit consent. There are a few exceptions to this confidentiality, for instance a legal obligation on which confidentiality may be broken. Personal data is not given to a country outside the European Economic Area (EEA).
Every healthcare provider has their own separate account and may only log in under his/her account. In exceptional cases such as an emergency, this rule can be broken.
4.2 Accountability
In order to comply without accountability obligations, we keep records of processing operations and any data breaches.
What do you have the right to?
5.1 Right to access and copy
You have the right to view your file under the supervision of a healthcare professional. This is only possible by appointment. Furthermore, you are also entitled to copy your file. Any notes from the healthcare professional are not covered within this right.
5.2 Right to correction
You have the right to correct incorrect personal data and add to to your personal file with your own opinion or a second opinion. For minor changes like your address, there is always the possibility of e-mailing or calling. For bigger changes, you are welcome to submit a request through telephone or by e-mail.
5.3 Right to erasure
You have the right to data erasure. However, sometimes this is not possible for example with legal obligations or lawsuits.
5.4 Other Rights
With regards to your data processing, you have the right to object and limit the data processing and to obtain your data in electronic form.
5.5 Right to Complain
If you have a complaint regarding the processing of your personal data, we kindly ask you to contact us. If this does not resolve the complaint, you can contact the Dutch Data Protection Authority. If you wish to exercise this right, we ask you to contact us in writing by e-mail. The e-mail address is stated at the top of this document. We aim to respond within four weeks.
